- Which system serves the property, where is it and where does it discharge?
- Does it serve other properties, and who pays for maintenance and repairs?
- Ask for plans, manufacturer instructions, maintenance reports and emptying records.
- Ask for the relevant regulator consent, registration, permit or explanation of the applicable England rules.
England: information for the new operator
For England’s ground-discharge guidance, the seller must tell the new operator in writing that a sewage discharge is in place. The guide specifies the description, locations, changes and available maintenance information to include.
England: the specific watercourse issue
Where a septic tank discharges directly to a watercourse, EA guidance says buyer and seller should agree responsibility for upgrading or replacement as a condition of sale. This is not a statement that every septic tank must be replaced whenever a house is sold.
Commission an appropriate inspection
- Ask an independent drainage professional what its survey includes and excludes.
- Ask whether the tank, outlet and drainage field can be assessed, and what cannot be established without further investigation.
- Ask for a written report distinguishing observed condition from assumptions.
- Give the report to your solicitor to discuss land rights, shared responsibilities and any proposed contract terms.
- For Scotland, Wales or Northern Ireland, ask the regulator about the existing authorisation and any ownership-change requirements; do not transfer England’s process by assumption.
